Probate legal help needed

jeudi 9 octobre 2014

If a couple have a valid up to date will and have no children and their will is for the surviving husband to receive everything is probate required? Or does it depend on amounts involved i.e. bank accounts, I was of the understanding when it's a joint account the death certificate is suffice and also the property if in joint names will transfer to the survivor but not sure on accounts / ISA's in solely the deceased name, the survivor also holds an ISA in their sole name with the same company. There is an executor named in the will but not sure if they need to act at this stage or not as the will is clear cut for the surviving spouse to receive everything. The surviving partner is 91 and has just lost his wife of 60+ years so I'm trying to find out as much as I can to help.

Any help would be much appreciated.
