I am turning to the wise folk of the BBS for help on a planning related query.
Around 7 months ago my neighbour submitted plans for an extension to their property. The main focus of the extension was quite a sizeable single story increase to the back of the house, including pitched roof. I looked at the plans online which all seemed reasonable, including a high level frosted window installation to the side of their property, looking into my boundary.
The application was approved and work commenced a couple of months ago. I noticed that the single story extension seemed to be built higher than any surrounding properties and when I saw the neighbour at the weekend, they explained that they had changed the scope of the roof due to cost. Having checked the portal I can see that one neighbour has already complained as the profile and design of roof is different to what was approved.
When I spoke to my neighbour at the weekend they mentioned that at some point the builder would require access to our property to install the side window. They briefly mentioned that they would show us the plan, which I thought was odd as it had been submitted with the planning permission some months ago.
I sent them a message tonight asking for the detail and likely timings and was a little frustrated by the response. It seems that the window will not be high level now and will instead be 1.1sqm. The window will still be obscured/frosted. They have also suggested it will open for ventilation purposes. They implied that this was included in the plans, which it wasnt. The plans clearly specify twice that the window will be high level and the drawing indicates it will be narrow.
It seems to me as if there is an element of scope creep in their plans, I was willing to accept their change in height of the extension, even though it runs along our boundary but now that they've also changed the window size and position,I do wonder if they were deliberately trying to mislead us and other neighbours at the planning stage.
I have asked to meet with him this weekend to discuss my concerns but would be interested to know the following;
1) what are the regs regarding installation of side windows facing my property
2) are they required to update planning with the changes mentioned above
3) in due course, I will be extending to.the side and possibly adding a fence along the boundary line, this could potentially block any light that they receive from their new window in any case - can the neighbour block my extension/installation of fence on these grounds?
