Insurance rip offs

In the last 4 years I've made 2 insurance claims, the first on my house insurance and at the moment have an on going motor insurance claim.

With both claims I have had nothing but hassle and hitting brick walls although with the house insurance claim it worked out fine in the end.

At present I am having major problems with my car claim. In a nutshell a woman stuck her car in reverse without looking and reversed into my car. Had witnesses and everything went smoothly to begin with. The car was still drivable and we were about to go on holiday so my insurance company delayed starting the claim til after our holiday.

On our return we were told by my insurance company Hastings direct that an accident management company called auxillis would deal with the claim. They sent a local garage to assess the damage. I pointed out to the assessor that the air conditioning, which was working perfectly before the accident had stopped working straight afterwards. At the time the car was 22 months old. The assessor said there were signs of corrosion on the air conditioning condenser but the accident was probably a contributing factor.

Auxillis gave us a courtesy car and ours went in for repair. It was delivered back to us last week on the hottest day scotlands ever had. The air conditioning was not working. I phoned the garage and the owner said that although he felt the third party was responsible they were refusing to admit liability for it saying it was caused by corrosion (the cars only fecking 22 months old ffs). I have spent the whole week arguing with my insurance company and auxillis telling them that although I was not at fault with the accident my car is not up to the spec it was before the accident.

I have taken it to the main dealer who are going to test it in 2 weeks but from looking at it they say that the corrosion is normal and because it is obvious the car has been involved in an accident it will not be covered under warranty. Hopefully they will write me a satisfactory report to send to the insurers but if they still refuse then u have the hassle of going to the small claims court.

Why should I have to be doing all this? If the third party insurance hadn't been so crooked and tight it woukd probably have cost an extra 300 quid. I've been made to feel like an insurance fraud when I'm totally innocent.

Any advice woukd be appreciated. I've contacted the ombudsman who are writing them a letter although I don't know what clout they have. I've also asked for auxillis complaints department to get involved which I've been told they are investigating.

I just think it's so wrong the way these companies are conducting themselves with little or no redress.
