Am I a tax evader / avoider?

On the way to work, at my local bakery / coffee shop, I will order a pastry and coffee to take away.

The coffee is subject to VAT whether you eat(drink)-in or take-away, but cold food is only subject to VAT if you eat-in.

I pay the take-away price, but as the coffee takes some time to make, I will make a start on the pastry whilst the coffee is prepared and have sometimes finished it before my coffee arrives.



Am I committing VAT fraud by doing this?

If the two foodstuffs arrived at the same time, I would consume both off the premises and I remain standing, not making use of the seats/tables.



AFAIK it is a british domiciled business, so I am not contributing to a Starbucks-style off-shoring of profits.
