I thought Id reach out to the BBS to see if any of the good folk on here can advise ?
At the end of my tether with a property I bought off plan.
Bought in 2015 off plan, I was told a parking space was included in the purchase. Fast forward to completion this year, and it turns out this has been missed off the contract and now the developer (well known) is trying to charge me £30k for a space. The context is that this is a large property that needs to have a parking space to sell (I.e this materially impacts the value of the overall plot).
The estate agent who sold the place to me in 2015 has now left the company and is working for another agent (not helpful !). He is however adamant that:
- it was included in the original price and is an admin error
- other reservation forms were filled out the same way and the owners got their spaces
The question is - do I have a claim for mis-selling against the Agent / Developer?
All witnesses to the transaction agree the basis on which it was sold. Unfortunately as all of the negotiation was done face-to-face I dont have any written confirmation.
Any advice appreciated !
or if anyone can recommend a good property litigator to have a quick conversation with, it would be much appreciated as well !
