Moving house. All coming to fruition and awaiting one final query from our sellers solicitors and we can then complete and set a date (which MUST be before 5th Aug as our buyers have to be out of their rented house on 6th).
The final query relates to the adoption of the road on which our new house sits. Even though the house was built 12 years ago, and despite an agreement being in place, the council have not adopted the road. The council refuse to tell my solicitor why and the sellers solicitors have been told to put the request for info in writing, which they did last week but have yet had a reply.
I have asked my solicitor if we can proceed anyway given that the fact the road is not adopted doesn't particularly bother me although accepting its a risk. The house is on a cul de sac of only 6 houses and therefore the road gets no through traffic. The bins etc are collected as normal.
My solicitors say they have to get my building society ok to proceed knowing the road is not adopted and that it is 'likely' they will refuse the mortgage (despite it being formally agreed 2 weeks ago) unless they know the reasons why.
Time is of the essence clearly. The sale falling through isn't an option !
