Path built above DPC

Ok so I’m turning to the BBS for assistance.


My elderly neighbour who lives on her own has asked me for help. Her neighbours have been building an extension to their house and in the process have built a concrete path that sits approx 6 inches above her DPC.

The boundary line to their property is according to the block plan her house wall.

We have contacted the local council who granted the planning permission but they aren’t interested as they say the building works are being signed off by a private company and passed their details on. After contacting the private company they aren’t interested either saying they only look at the building works on plan but not the pathway.

She unfortunately doesn’t have legal cover with her home insurances.

We had a damp company come over on Monday to check the property and found it free from damp which is expected at only built mid eighties.
The report from them has just come through stating

‘Further to your recent request, our Surveyor ***** inspected the flank wall externally of the above property on 25th August 2020 and noted that the new path has been laid at a higher level and is bridging the damp proof course.
We recommend therefore that the height of the path is reduced to 150mm below the damp proof course.’

We are planning to speak to the owner tomorrow showing the report and requesting the works are done immediately. If this fails and doesn’t get done what are my next options?

I’ve attached the block plan elderly lady lives at 27 and the works are going on at 28.
