Wonder if any BBS lawyers can help.
My salary is due today and has not been paid. The MD of my company is a shady character and this kind of thing has happened in the past with payments getting made later in the day. But recently his general behaviour has been at best unreliable and mostly pretty outrageous. It is getting to the point where I am thinking of reporting him as being unfit to be a company director. However after looking into this it seems to me that morally bad behaviour which he is guilty of is not enough, he needs to be failing in his legal responsibilities.
Some examples of his antics are:
Putting his original company (I was employed by) into administration and starting a new one. This bit is perfectly legal but we were told we would all be tuped over to the new company after consultations and receive new contracts. We have had no consultation or contracts but were simply put on new company payroll.
Our pension contributions are being deducted from our salaries but not being paid into the fund. We have been notified by the pension company he has been reported for this.
For several weeks the company had no insurance of any kind.
His wife counts cash received and banks it but if she counts say £1K, she records that then banks a lower amount. Never gives any explanation so is robbing money.
There are plenty of other examples but does this constitute he is an unfit director or just a total c unit?
