So he lost at the Supreme Court, and now it goes all the way back to the Magistrates.
With a young child in year 1 (and another one at nursery, so will be in school in a few years), I am in a similar position. We are going away next month, and are taking her out of school for 4 days, and have saved around £1k in the process - so we were more than willing to accept the fine if it happened, as we'd still be money good.
We would never consider taking them out of school at a critical time - start of the year, lead up to any tests etc, but surely in reception and year 1 (and maybe 2 if they drop the SATS), there should be some leeway to a point to allow some amount of term time absence as acceptable?
