Out of the blue claims following a road accident

samedi 14 mars 2015

I know I don't post on here much these days but i am absolutely seething today. Basically, Monty had an accident back in October, her first ever in 27 years of driving. The car was a write off but no statements were taken as no one was visibly injured, and the insurance company settled the same week.

Anyway, today I open a letter and it's a claim out of the blue from the other party involved to the tune of over £2.5k.for the cost of car recovery and hire of another one plus physio for injuries resulting from the accident (even though he had to take no time off work whatsoever).

Now, I now we live in a world of litigation and blame and people taking advantage of the fact that they are encouraged to claim for nigh on anything, but does this person have a case?

Anyone got any experience in this area, either as an insurer or someone on the receiving end of a similar experience?

Monty is devastated about it. As I say, she's never ever had an accident before and swears that this bloke just came out of nowhere and pulled across her at a roundabout. It's a your word against mine scenario and frankly I'd rather just pay up than have a protracted court battle or incur loads of legal costs. However, at the same time, if the claimant is taking the piss or changing their arm, equally, I'm not up for letting them just walk away with the cash. I;m just very angry about it as at the time the bloke made no fuss and said to monty when they exchanged details that it was "just one of those things".
